GOP Senator Larry Craig Arrested For "Lewd Conduct" In Men's Room
Breaking news from Roll Call:
Sen. Larry Craig (R-Idaho) was arrested in June at a Minnesota airport by a plainclothes police officer investigating lewd conduct complaints in a men’s public restroom, according to an arrest report obtained by Roll Call Monday afternoon.Craig’s arrest occurred just after noon on June 11 at Minneapolis-St. Paul International Airport. On Aug. 8, he pleaded guilty to misdemeanor disorderly conduct in the Hennepin County District Court. He paid more than $500 in fines and fees, and a 10-day jail sentence was stayed. He also was given one year of probation with the court that began on Aug. 8.
Here's what Craig did that day, according to the incident report filed by plainclothes officer Dave Karsina:
Craig then entered the stall next to Karsnia’s and placed his roller bag against the front of the stall door.“My experience has shown that individuals engaging in lewd conduct use their bags to block the view from the front of their stall,” Karsnia stated in his report. “From my seated position, I could observe the shoes and ankles of Craig seated to the left of me.”
Craig was wearing dress pants with black dress shoes.
“At 1216 hours, Craig tapped his right foot. I recognized this as a signal used by persons wishing to engage in lewd conduct. Craig tapped his toes several times and moves his foot closer to my foot. I moved my foot up and down slowly. While this was occurring, the male in the stall to my right was still present. I could hear several unknown persons in the restroom that appeared to use the restroom for its intended use. The presence of others did not seem to deter Craig as he moved his right foot so that it touched the side of my left foot which was within my stall area,” the report states.
Craig then proceeded to swipe his hand under the stall divider several times, and Karsnia noted in his report that “I could ... see Craig had a gold ring on his ring finger as his hand was on my side of the stall divider.”
Karsnia then held his police identification down by the floor so that Craig could see it.
“With my left hand near the floor, I pointed towards the exit. Craig responded, ‘No!’ I again pointed towards the exit. Craig exited the stall with his roller bags without flushing the toilet. ... Craig said he would not go. I told Craig that he was under arrest, he had to go, and that I didn’t want to make a scene. Craig then left the restroom.”
In a recorded interview after his arrest, Craig “either disagreed with me or ‘didn’t recall’ the events as they happened,” the report states.
Craig stated “that he has a wide stance when going to the bathroom and that his foot may have touched mine,” the report states. Craig also told the arresting officer that he reached down with his right hand to pick up a piece of paper that was on the floor.
“It should be noted that there was not a piece of paper on the bathroom floor, nor did Craig pick up a piece of paper,” the arresting officer said in the report.
A very quick check of Craig's record on gay issues turns up the fact that he voted in favor of an Idaho Constitutional amendment defining marriage as between a man and a woman, and also voted in favor of last year's Federal Marriage Amendment doing the same thing.
Though it should be noted that neither of those votes is directly at odds with engaging in lewd conduct in a public men's rest room.
Late Update: The Roll Call piece is not accessible right now, so let me add that it contains this denial from the Craig camp:
A spokesman for Craig described the incident as a “he said/he said misunderstanding,” and said the office would release a fuller statement later Monday afternoon.
"He said, he said?"

Yeah, the foot tapping is some kind of universal signal. A college buddy of mine almost beat up a guy who peered under the door of his bathroom stall at the school library.
After my friend got rather belligerent, the guy apologized profusely for the misunderstanding and said he heard him tapping his foot and that was the sign he wanted a "date".
Beyond that, even if Craig argued he wasn't cruising for anonymous bathroom sex, he is guilty of battery, which is defined as "an offensive touching". If you're sitting in a bathroom stall and some stranger reaches under the stall and touches your foot with his, that would certainly count.

The intentions of the Senator were never irrefutably established. Something was definitely up here.
The explanation for what happened says it all. He had a "wide stance". Is that a classic or what? I wonder how wide the stall is. Double shoulder width, 3/4 split? That must have been quite a terd if you would excuse the toilet humor.
This gives me flashbacks of the first Austin Powers movie when Austin Powers is fighting in the stall when he suddenly got attacked from behind via a false wall opening.

As a defense attorney, I would take that to a bench trial and have the judge kick it out. There is not enough evidence there to create a lewd act legally.
Non legally it is a bit strange and certainly was meant as it was taken by the police officer. Clearly he plead out for political reasons which is just too funny to me. The republicans certainly can throw out some crazy characters.
Let this be a lesson to everyone. Never try to take on the state or federal government without an attorney. Especially when you can afford one as Craig can.

That policeman had been called to investigate because, as Roll Call says, the "plainclothes police officer [was] investigating lewd conduct complaints."
So at least one member of the public had been approached by Craig for "lewd conduct" or had witnessed/overhead such conduct.
So, part of the reason for the plea could well be that Craig did not want to have whatever was alleged by the original witness come to light at trial.
I guess the pages in the bible concerning homosexuality were worn out for reasons other than those Craig has been pointiing out....

The offense of this, and the reason it's an arrestable offense, is that gay sex in the public bathroom is a common crime which disgusts and outrages most of society. The guy pled guilty to lewd conduct, he was attempting to have sex in public with a random stranger, is that not offensive to you? Law takes intent into account, the officer wouldn't have arrested the man if he hadn't obviously committed to propositioning him. Whether or not a lawyer could have got him off is immaterial, he's toast either way in the public eye. Good riddance.

Also, why does the officer move his foot "slowly up and downs" if not for entrapment? What a state, where cops do this sort fo thing and talk about it afterwards like it was proper beahvior for a police officer. It's not convincing at all. In fact, with just two people in the restroom, the cop and LC, it would be mroe convincing.
Also, how was the bag gonig to block when they weren't in the same stall ? Those partitions are only 8-10 inches off the ground, so one of them would have to dive under and roll into the other stall. A stupid roller bag could block the view anyway of that, or 4 feet on the floor, they're only 1/2 to 1/3rd the width of a stall. One or two steps outside by someone washing or drying hands and the 4 feet would be easily revealed.
It's got a real tainted smell to it, the whole thing.

Everybody who doesn't understand the gay way need to do a little looking around. A very small percent of the gay community (.0001) go to public bathrooms for a quickie. There are books that list popular tea rooms as they are called, and list where you can cruise for sex. The media does the general public little for not bringing in the facts that certain "hot spots" become feeding grounds for gay sex. Just like the red light district for straights. Pretty sad he couldn't just go to a gay bar around closing time, or rent a escort. I don't buy into the "I like the danger" excuse. Pretty lame if you ask me. Glad the right are getting a touch of reality. Their party moralizes way too much to do anyone good as a whole.

First of all, I would say to SiliconDoc that you have to view this arrest in context. The Minne-St/Paul airport restroom was already notorious as a hotbed of gay sexual activity and the police were responding to public calls to do something about it. When the undercover cop perceived a commonly used gay sex signal, he did the logical thing and made an arrest.
Obviously, whatever Sen Craig did or did not do after that point did not help his case. I find particularly damning, the fact that he handed the cop a business card which identified him as a Senator and expected that to make it "go away."
This is not the first time gay allegations have been made about Senator Craig. Over the apst twenty years or so tehre have been several such rumors and allegations. As some other blogger said, he's either gay or the unluckiest sonofabitch who ever lived!
